These general terms and conditions of sale (hereinafter the «GTCS») apply without restriction or reservation to all purchases and reservations from HOTEL JUANA HOTEL TOURISME, whose registered office is located at HOTEL JUANA, JUAN LES PINS AVENUE GEORGES GALLICE 06160 ANTIBES, whose VAT number is

FR25035920818, registered with the Antibes SIRET under number 035920818 (hereinafter referred to as the ’Hotel«) of a stay in the hotel rooms Hotel Juana and ancillary services offered by the Hotel (hereinafter together referred to as the «Services») by consumer customers or travel agencies (hereinafter referred to as the «Customer(s)»). The «Juana» hotel has been classified as a 5-star establishment following a decision by Atout France. This classification was pronounced in the year 2025 for a period of 5 years.

These GCS are systematically communicated to all Customers prior to the conclusion of the contract for the provision of Services. They govern all stages necessary for the reservation and follow-up of the reservation between the contracting parties.

As these General Terms and Conditions may be subject to subsequent modifications, the version applicable to the Customer's purchase is that in force on the day the reservation is validated. The Hotel reserves the right to modify the opening and closing times of its Services.

Reservations:

The Customer may reserve the Services by telephone or e-mail using the Hotel's contact details given above, or via the Hotel's website.

 

 

The Hotel reserves the right to cancel or refuse any reservation from a Customer with whom there is a dispute concerning the payment of a previous order.

 

 

In the event of booking by telephone or e-mail, a summary e-mail is sent to the Customer to confirm the booking of Services and thus form the contract.

If the Customer makes a reservation via the Internet Site, he/she selects the Services he/she wishes to reserve, as follows:

 

 

  1. Select room type and rate ;
  2. Selection of ancillary services if applicable ;
  3. Check and validate booking details, total booking amount and fare conditions; ;
  4. Contact details ;
  5. Entry of credit card details in the event of prepayment, deposit or the Hotel taking out a guarantee and pre-authorization at the time of the customer's arrival; ;
  6. Consult and accept the Hotel's General Terms and Conditions, Privacy Policy and Personal Data Protection Policy (by ticking the two boxes provided for this purpose) and the conditions of the selected rate before confirming your reservation; ;
  7. Booking validation: The customer has the opportunity to check the details of the booking, its total price and to correct any errors before confirming acceptance by double-clicking. It is therefore the customer's responsibility to check the accuracy of the booking and to report any errors immediately; ;
  8. Reservation confirmation e-mail: The sale of Services will only be considered definitive once the Customer has received confirmation of acceptance of the reservation.

By placing an order, the Customer acknowledges that he/she has familiarized himself/herself with the nature, purpose and reservation terms and conditions of the Services offered by the Hotel, and that he/she has requested and obtained the information necessary to make a reservation with full knowledge of the facts. The Customer is solely responsible for his or her choice of Services and their suitability for his or her needs, and the Hotel cannot be held liable in this respect.

By placing an order, the Customer attests to the truthfulness and accuracy of the information provided.

Any reservation of Services made on the Hotel's Internet Site constitutes the formation of a contract concluded remotely between the Customer and the Hotel.

 

 

Hotel arrival

 

 

In accordance with current regulations, foreign customers will be asked to complete an individual police form on arrival at the hotel. Customers will be asked to show proof of identity.

 

 

The rooms

 

 

Rooms are available from 3pm and must be vacated by midday. In case of late arrival, please inform us. Any unauthorized late departure between 12:00 and 15:00 will be charged €500, and after 15:00 will be charged at the current rate for the night.

 

 

All our rooms are non-smoking.

 

 

If your room smells of tobacco during or after your stay, you will be charged for one night's stay without prior notice.

 

 

Rates

 

 

Room rates vary according to booking date and availability for the room category requested. Prices are quoted in euros. They are per room and per night, all taxes included. The tourist tax is communicated to the customer prior to booking and remains an additional charge on top of the room rate. In the event of a change in tourist tax once your reservation has been made, the new amount will be invoiced.

 

 

Information on dynamic rate management (Yield Management)

In accordance with the opinion of the Conseil National de la Consommation of January 27, 2020 relating to fine price management, the Hotel informs the Customer that room and service rates may be subject to dynamic modulation according to various criteria such as the period, occupancy rate, demand or booking conditions.

 

 

This yield management practice aims to ensure a better match between supply and demand, and does not constitute a price reduction within the meaning of article L.112-1-1 of the French Consumer Code.

 

 

Relocation

 

 

In the event of an exceptional event or a case of force majeure within the meaning of Article 1218 of the French Civil Code preventing the Hotel, in whole or in part, from making the reserved room available to the Customer, the Hotel reserves the right to cancel all or part of the reservation and Services, or to offer all or part of an alternative accommodation to the Customer, in a hotel of equivalent category, for services of the same nature.

It is expressly agreed that force majeure, within the meaning of these GTC, insofar as it prevents the performance of the Hotel's obligations, includes (but is not limited to) the following events: epidemics, strikes, floods, failure of the water or electricity supply, fires, acts of terrorism, riots, necessary maintenance work, breakdowns or other acts of God.

Reservations and payment methods

 

 

The reservation of Services will only be effective if it is guaranteed by the Customer, either by providing a credit card number with its validity date, or by paying a deposit, and after receipt of a detailed reservation confirmation by e-mail from the Hotel. Payment for all Services must be made directly to the Hotel (after deduction of the deposit paid at the time of booking). The Hotel reserves the right to refuse any reservation if the credit card number is incorrect or the reservation incomplete.

 

 

Pre-authorization: On arrival at the hotel, a pre-authorization will be made on a physical and nominative bank card, the holder of which must correspond to the resident staying in the establishment. This pre-authorization covers the balance of the stay as well as an additional provision to guarantee payment of additional services of 100e per night (minibar, catering, spa, etc.). In the absence of a valid pre-authorization, the establishment reserves the right to refuse access to the room or to request immediate payment of the entire stay and security deposit.

 

 

Online bookings on partner websites: For bookings made via our partners' websites, cancellations must be made via this website. The cancellation conditions that apply are specific to the partner and may therefore differ from those of the Hotel.

Depending on the Services booked and the booking method, payment for Services is made in full or in part on the day of booking, in accordance with the payment terms sent to the Customer prior to order validation, and the outstanding amount is paid, where applicable, on the day of the Customer's arrival at the hotel. Payment can be made by credit card, by bank transfer if the validation period is in accordance with the cancellation conditions, or in cash (if the price does not exceed 1,000 euros).

Cancellation and modification conditions, excluding special or promotional offers

In accordance with article L. 121-21-8 12° of the French Consumer Code, customers are reminded that they do not have the right of withdrawal provided for in article L. 121-21 of the French Consumer Code.

The conditions of sale of the reserved fare specify the terms and conditions for cancelling and/or modifying the reservation.

 

 

Reservation conditions: 50% deposit for the entire stay (credit card or bank transfer). In the event of cancellation by the Hotel for reasons other than force majeure as defined in the «Displacement» article of these GTC, the consumer customer is entitled to compensation equal to double the deposit paid.

 

 

Modification conditions: Any request to modify the Services in relation to the Services booked must be sent in writing (fax, e-mail or post) to the Hotel.

In the absence of written acceptance by the Hotel within 8 days of receipt of the request, the contract is deemed to continue under the terms and conditions determined when the Services were booked. A double or twin room is intended for 2 adults. If the number of people actually staying at the hotel is greater than the number of people indicated by the Customer when booking Services, the Hotel may have to allocate a room of a different category or a second room on arrival. In this case, you will be responsible for all supplements and a new rate will be applied according to the room you have booked.

 

 

Customer cancellation conditions: any cancellation by the customer must be confirmed in writing (letter, e-mail). Cancellation/modification conditions are specified in the customer's confirmation and may differ depending on the period of stay.

 

 

 

 

 

 

 

Animals

 

Under certain conditions, the hotel accepts well-behaved dogs weighing less than 5kg in certain rooms only, subject to prior approval by the hotel. The conditions are: they must be kept on a leash at all times and in all places, for reasons of hygiene, animals are not accepted in indoor restaurants (with the exception of guide dogs) and they must weigh less than 5kg. If the dog is left alone in the room, it is the customer's responsibility to inform the hotel, so that room service can carry out its work in complete safety. The supplement is from €30 per day per animal. In the event of damage, the customer will be charged for the cost of repairs.

 

 

Liability, theft, damage

The Hotel cannot be held responsible for the theft, loss or deterioration of guests' luggage or personal belongings stored in the common areas of the hotel, in a room, on room terraces, left in restaurants, lounges, swimming pools and spas, or in a car in the hotel parking lot during their stay, or anywhere else in the hotel. The Customer will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of occupying the premises and/or as a result of the participants and/or staff for whom he/she is responsible, to movable, decorative and immovable property belonging or not belonging to the Hotel. As a result, the Hotel reserves the right to ask the Customer to leave the establishment without any compensation or reimbursement for the stay in progress, and to reimburse any damage caused by his or her actions.

Any missing equipment or damage, as well as any minibar consumed but not reported on departure, will be billed to you without notification.

 

 

Nuisances

A hotel room is a place of rest. The Customer accepts and undertakes to use the room in a reasonable manner. Any behavior that is contrary to public decency or public order will lead the Hotel to give the Customer verbal notice to cease the reprehensible behavior. In the absence of a definitive cessation of reprehensible behavior on the part of the Customer, the Hotel reserves the right to ask the Customer to leave the establishment without any compensation or refund (even if payment has already been made), and to claim damages and interest in compensation for any damage or nuisance suffered.

 

Disputes

All claims must be sent by registered mail with return receipt to the Hotel no later than 30 days after the Customer's departure date. After this deadline, no claim can be taken into account.

 

 

If the Customer is a professional

ANY DISPUTE ARISING OUT OF OR IN CONNECTION WITH THE INTERPRETATION OR PERFORMANCE OF THESE GTCS SHALL BE SUBMITTED TO THE ANTIBES COMMERCIAL COURT.

 

 

If the Customer is a consumer

Consumer customers are hereby informed that they may have recourse to the Consumer Mediator, whose contact details are as follows: www.mtv.travel

 

 

The consumer customer is also informed of the existence of the European platform for online dispute resolution (RLL). Should the mediation procedure fail, the most diligent party may refer the matter to the competent courts.

 

 

Personal data

 

 

Pursuant to Regulation (EU) No. 2016/679 of the European Parliament and of the Council of April 27, 2016 and the French Data Protection Act No. 78-17 of January 6, 1978, as amended by Act No. 2018-493 of June 20, 2018, together relating to the protection of individuals with regard to the processing of personal data, the Customer's personal data is processed by the Hotel, which acts as the data controller.
